- Sensitive Personal Information as defined by applicable laws, including government identification numbers, biometric information, account log-in and password, credit or debit card number, precise geolocation, racial or ethnic origin, and Personal Information collected and analyzed concerning a consumer’s health, sex life, or sexual orientation.To the extent any Sensitive Personal Information constitutes Protected Health Information (PHI), it is collected and used solely for treatment, payment, and healthcare operations and is governed by HIPAA rather than state consumer privacy laws.

Unless you take action to re-identify your de-identified information, we will not attempt to re-identify this information so that it may be associated with you. Any advertising or analytics activities expressly exclude Protected Health Information and are limited to non-health, non-prescription related interactions, such as website usage.

Please note that certain information we collect is governed by HIPAA rather than state privacy laws. Requests relating to Protected Health Information are subject to our HIPAA Notice of Privacy Practices, as described in Section 5, and CPRA rights may not apply to such information.
We will not discriminate against you if you decide to exercise your privacy rights.
c) Agent Requests
Only you, or someone legally authorized to act on your behalf, may submit a request related to your Personal Information.
Depending on your U.S. state of residence, you may authorize someone to make a privacy rights request on your behalf (an authorized agent). Authorized agents will need to demonstrate that you’ve authorized them to act on your behalf. Grizzly Pharmacy – Fresno retains the right to request confirmation directly from you confirming that the agent is authorized to make such a request, or to request additional information to confirm the agent’s identity.
d) Opt-Out Requests
You may request to opt out of the sharing of Personal Information for targeted advertising purposes, where applicable, by using available opt-out mechanisms or by contacting us.
Submitting an opt-out request does not require you to create an account with us.
e) Right to Appeal

5. Text Messaging and Mobile Information
We respect your privacy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
6. HIPAA Notice
Relationship Between HIPAA and State Privacy Laws
To the extent that any Personal Information collected by Grizzly Pharmacy – Fresno is considered “Protected Health Information” (“PHI”) under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) and its implementing regulations, HIPAA and applicable state health privacy laws govern our use and disclosure of that information. In those circumstances, the rights and obligations set forth in this Privacy Policy and under the California Privacy Rights Act (“CPRA”) may not apply to such PHI.
