Grizzly Pharmacy – Fresno Notice of California Resident Privacy Rights (CPRA)

1. Personal Information We Collect

There are several ways we may collect Personal Information about you, including through information you provide to us; information we collect through your use of the Services and interactions with us; information we receive from third parties; and by combining information from different sources. This includes data that identifies you personally, whether directly or indirectly.   • Identifiers/demographic information, such as name, age, date of birth, sex, gender, postal and email address, phone number, and online identifiers, Internet Protocol (“IP”) address, and other similar identifiers.
  • Commercial information, such as items purchased, obtained, or considered and other purchasing or consuming histories or tendencies.
  • Internet or other electronic network activity information.
  • Geolocation data (non-precise).
  • Audio, electronic, visual, or similar information.
  • Inferences, meaning inferences drawn from the listed categories of Personal Information reflecting consumer preferences or characteristics.
  • Sensitive Personal Information as defined by applicable laws, including government identification numbers, biometric information, account log-in and password, credit or debit card number, precise geolocation, racial or ethnic origin, and Personal Information collected and analyzed concerning a consumer’s health, sex life, or sexual orientation.To the extent any Sensitive Personal Information constitutes Protected Health Information (PHI), it is collected and used solely for treatment, payment, and healthcare operations and is governed by HIPAA rather than state consumer privacy laws.

When you use our Services, we may collect Personal Information from you, such as when you create an account, your interactions with our Grizzly Pharmacy – Fresno stores, our Site or your enrollment in programs such as telephonic and electronic notifications.

  • Social Media Platforms (note that the information we receive from such platforms is dependent upon their policies and your settings on the platforms).

For example, we may combine Personal Information that we receive from third parties with Personal Information we already have about you. Please note that we may de-identify or aggregate Personal Information so that it will no longer be considered Personal Information and disclose such information to other parties for purposes consistent with those described in this Privacy Policy. Unless you take action to re-identify your de-identified information, we will not attempt to re-identify this information so that it may be associated with you. Any advertising or analytics activities expressly exclude Protected Health Information and are limited to non-health, non-prescription related interactions, such as website usage.

4. Your Privacy Choices and Rights

You have the ability to make certain choices about how we use your Personal Information, as follows:

a) Unsubscribing from our Marketing and Promotional Communications

From time to time, we may send you marketing and promotional communications, including special offers from us. If you no longer wish to receive promotional and marketing emails from us, you may opt out of such communications at any time by following the opt-out instructions included in any promotional or marketing email you receive from us.

b) Privacy Rights and Requests

Please note that we may not be required to respond to your requests “to know” or access specific pieces of Personal Information more than twice in any 12-month period.
  • Right to Request Specific List of Third Parties: You may have the right to request a list of the specific third parties with whom we have shared or sold your Personal Information.
  • Right to Request a List of Categories of Third Parties: You may have the right to request a list of the categories of third parties to which we have disclosed Personal Information.
  • Right to Data Portability: You may have the right to access your information in a portable format.
  • Right to Delete: You may have the right to request that we delete Personal Information that we have collected from or about you, subject to certain exceptions.
  • Right to Correct: You may have the right to correct inaccurate Personal Information that we may maintain about you, subject to appropriate verification.
  • Right to Opt Out of Certain Types of Personal Information Uses and Disclosures: We use and disclose to third parties Personal Information for analytics and advertising purposes. Accordingly, you may have the right to opt out of the “sale” or “sharing” of your Personal Information, or the use and disclosure of your Personal Information for “targeted advertising” (as these terms are defined under applicable law).
  • Right to Limit Use of Sensitive Personal Information: You may have the right to limit our use and disclosure of Sensitive Personal Information to purposes permitted by law.

Please note that, where permitted under applicable law, we may decline a request (other than for opt outs) if we are unable to verify your identity (or an agent’s authority to make the request) and confirm the Personal Information we maintain relates to you.

We may take steps to verify your identity before responding to your request by asking you a series of questions about you or your previous interactions with us. Submitting a privacy rights request does not require you to create an account with us.

Please note that certain information we collect is governed by HIPAA rather than state privacy laws. Requests relating to Protected Health Information are subject to our HIPAA Notice of Privacy Practices, as described in Section 5, and CPRA rights may not apply to such information.

We will not discriminate against you if you decide to exercise your privacy rights.

c) Agent Requests

Only you, or someone legally authorized to act on your behalf, may submit a request related to your Personal Information.

Depending on your U.S. state of residence, you may authorize someone to make a privacy rights request on your behalf (an authorized agent). Authorized agents will need to demonstrate that you’ve authorized them to act on your behalf. Grizzly Pharmacy – Fresno retains the right to request confirmation directly from you confirming that the agent is authorized to make such a request, or to request additional information to confirm the agent’s identity.

d) Opt-Out Requests

You may request to opt out of the sharing of Personal Information for targeted advertising purposes, where applicable, by using available opt-out mechanisms or by contacting us.

Submitting an opt-out request does not require you to create an account with us.

e) Right to Appeal

5. Text Messaging and Mobile Information 

We respect your privacy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

6. HIPAA Notice

Relationship Between HIPAA and State Privacy Laws

To the extent that any Personal Information collected by Grizzly Pharmacy – Fresno is considered “Protected Health Information” (“PHI”) under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) and its implementing regulations, HIPAA and applicable state health privacy laws govern our use and disclosure of that information. In those circumstances, the rights and obligations set forth in this Privacy Policy and under the California Privacy Rights Act (“CPRA”) may not apply to such PHI.

Certain information we collect may be considered Protected Health Information (PHI) under HIPAA. Our use and disclosure of PHI is governed by our Notice of Privacy Practices, which is available upon request at the pharmacy and may be available on our website.

7. Children’s Privacy

Our Services are intended for a general audience. We do not direct our Services to individuals under eighteen (18), nor do we knowingly solicit or collect any Personal Information from individuals under eighteen (18).

8. Data Security

We have implemented physical, administrative, and technical safeguards to maintain the security, confidentiality, and integrity of your information. However, as no transmission of information over the internet is absolutely secure, we cannot guarantee the safety of your information.

9. Revisions To This Privacy Policy

We reserve the right, in our sole discretion, to change, modify, add, remove, or otherwise revise portions of this Privacy Policy at any time. When we do, we will post the change(s) to our Services. Your continued use of our Services following the posting of changes to these terms means you accept these changes. If we change the Privacy Policy in a material way, we will provide appropriate notice to you and seek your consent where required by applicable privacy laws.
